This Privacy Policy governs the collection, processing, and use of personal data by apx GmbH ("we," "us," or "our") across our entire digital ecosystem. This includes our websites, learning app, training app, recruitment pathway and any other related systems. By accessing our website, purchasing a membership, or downloading our apps, you acknowledge the practices described herein.

The party responsible for data processing on this website and in the apps (the "Controller" pursuant to Art. 4 No. 7 GDPR) is apx GmbH, headquartered at Schneckenburgerstraße 32, 81675 Munich, and registered with the commercial register at the Amtsgericht München (District Court of Munich) under the registration number HRB 297183. Our legally authorized representative and Managing Director is Jason Emilio Sanders, also serving as the Data Protection Officer .

Data Collection on our Website

Hosting (Framer & IONOS)

We host our website with Framer, Inc. (398 11th Street, 2nd Floor, San Francisco, CA 94103, USA) and use IONOS SE (Elgendorfer Str. 57, 56410 Montabaur, Germany) for backend services. When you visit our website, these providers automatically collect technical data (log files) such as your IP address, browser type, and time of access to ensure the security and stability of the site.

  • Legal Basis: Art. 6(1)(f) GDPR (Legitimate Interest).

  • US Transfer: Webflow is certified under the EU-US Data Privacy Framework (DPF), ensuring compliance with EU data protection standards.

Hosting Cookies and Consent Management (Cookiebot)

We use "Cookies" to optimize our website. To manage your consent preferences legally, we use Cookiebot (Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark).

  • Essential Cookies: Necessary for the website to function (e.g., shopping cart, login).

  • Analytics/Marketing Cookies: Only activated with your explicit consent via the banner.

  • Legal Basis: Art. 6(1)(c) GDPR (Legal Obligation) for the consent tool itself; Art. 6(1)(a) GDPR (Consent) for non-essential cookies.

Hosting Contact Forms and Communication

If you contact us via e-mail or the contact form, your data (name, email, inquiry details) will be stored to process your request.

  • Legal Basis: Art. 6(1)(b) GDPR (if related to a contract/order) or Art. 6(1)(f) GDPR (Legitimate Interest).

Data Collection in the Apps (Apx Learning & Apx Training)

When you download and use our apps, additional data categories are processed to provide the coaching experience.

Account and Registration Data

To access the Academy content or Training plans, you must create an account. We collect:

  • Name, Email address, Password (hashed/salted).

  • Date of Birth (The app is strictly for users aged 13+).

  • SSO Data: If you use Apple Sign-In or Google Sign-In, we receive your authentication token and basic profile info.

Athletic Profile (Health Related Data)

To personalize your training, we collect information regarding your athletic profile, including your sport, position, level of play, and training goals. Legal Basis: By voluntarily providing this data for the purpose of coaching, you explicitly consent to its processing pursuant to Art. 9(2)(a) GDPR.

User-Generated Content (UGC) & Community

If you upload videos or post in public areas of the app, this content (including your Profile Picture and Bio) is visible to other users. We advise against posting sensitive personal data in public areas. Device Permissions: The app may request access to your Camera, Microphone, or Photo Library to enable these features. You can revoke these permissions at any time in your device settings.

AI Coach (Artificial Intelligence)

We use Google Gemini (and similar LLM providers) to power the "AI Coach" feature. When you submit text prompts to the AI Coach:

  • Your text is transmitted to the provider solely to generate a response.

  • We restrict providers from using your data to train their general public models.

  • We do not permanently store the conversation history after the session concludes.


E-Commerce and Subscriptions

Purchasing Memberships

We offer subscriptions ("Memberships") directly via our website. Users may also start a free trial.

  • Process: You purchase the subscription on the website. This unlocks access to premium content inside the Apps.

  • Legal Basis: Art. 6(1)(b) GDPR (Performance of a Contract).

Payment Processing (Stripe)

We do not store your credit card data. All payments are processed by Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). We use Stripe Connect to manage transactions. Stripe collects identifying information and payment details directly from you. Stripe may transfer data to the USA under the EU-US Data Privacy Framework. For details, please refer to Stripe’s Privacy Policy.

Recipients of Data (Service Providers)

We do not sell your data. We share data only with trusted third-party providers necessary to operate our service.

App Infrastructure & Analytics

We use the following providers to host the app, analyze usage, and route data:

  • Amazon Web Services (AWS) & Google Cloud: Secure cloud hosting.

  • Segment (by Twilio): Customer data infrastructure to route usage data securely.

  • RevenueCat: Manages subscription status and access control across web and mobile.

  • Google Analytics: To analyze user behavior and improve the app.

Training Platform Provider (Everfit)

To deliver specific training plans and coaching functionality (The "Training App"), we utilize the infrastructure of a third-party white-label provider (Everfit).

  • Data Transfer: When you use the Training App features, your account data and training logs are processed on Everfit’s servers on our behalf.

  • Safeguards: We have concluded a Data Processing Agreement (DPA) with this provider to ensure they process data strictly according to our instructions.

Freelance Coaches

We may grant limited access to your data (e.g., messages, booking details) to freelance coaches within the App to provide you with personal guidance. These coaches are bound by strict confidentiality agreements.

International Data Transfers

Some of our service providers (e.g., Webflow, Stripe, Google, AWS, Segment) are located in the USA. We ensure that data transfer is compliant with GDPR Chapter V by relying on:

  1. The EU-US Data Privacy Framework (DPF) for certified companies.

  2. Standard Contractual Clauses (SCCs) provided by the EU Commission for other providers, ensuring an adequate level of data protection.

Data Retention and Deletion

We retain your personal data only for as long as your account remains active or as required to fulfill the contract. Account Deletion: You may request account deletion via the App settings. Upon request, your profile and personal data will be permanently deleted or anonymized, unless statutory retention periods (e.g., tax laws for payment data) require longer storage.

Job Applications

If you apply for a job with us via the website or email, we process your data (CV, certificates) solely for the application process (§ 26 BDSG).

  • If hired, data is transferred to our HR files.

  • If not hired, data is deleted after 6 months unless you consent to join our applicant pool for future openings (storage for up to 2 years).

Your Rights (GDPR)

You have the following rights regarding your personal data:

  • Right to Access (Art. 15 GDPR): Request a copy of your data.

  • Right to Rectification (Art. 16 GDPR): Correct inaccurate data.

  • Right to Erasure (Art. 17 GDPR): "Right to be forgotten."
